1.  EYE ON OCT COMMUNITY TERMS OF USE

    I. INTRODUCTION

   This website includes without limitation: (a) on-line services at www.oct.zeiss.com (EOC) and other on-line services accessible via the EOC (collectively the "Services"); (b) information such as technical, contractual, product, program, pricing, marketing, practice resources and other valuable information ("Information"); and (c) content such as data, text, sound, photographs, graphics, video, messages, or other materials ("Content"). Carl Zeiss Meditec, Inc., (“Zeiss”) controls and operates its websites from various locations and makes no representation that the EOC is appropriate or available for use in all locations. If You are using the EOC, You represent and warrant that You are authorized to accept these Terms.

    

   II.  LEGAL

   1.  DISCLAMER

   The Carl Zeiss Meditec, Inc., (“Zeiss”) Eye on OCT Community (“EOC”) site is provided as a source of useful information, not medical advice. Zeiss is not responsible for the content of the sites linked to from the EOC and does not guarantee the accuracy of the content of the sites or of the EOC itself. The inclusion of a link to a site should not be construed as Zeiss’s endorsement of the site, its sponsoring organization, or any views expressed in the site. 

   2.  TRADEMARKS

   “Eye on OCT”, “Carl Zeiss” and the Zeiss logo are trademarks of Carl Zeiss AG and Carl Zeiss Meditec AG, and may not be reproduced without Zeiss’s prior written consent. The logos displayed in this EOC may be trademarks of their affiliated organizations. All of the logos are used with permission for the sole purpose of inclusion in this EOC, and Zeiss does not have the authority to permit third parties to reproduce the logos. If You are interested in reproducing the logos, You should address the organizations directly.

   3. COPYRIGHT POLICY

   All of the original material in this EOC, including but not limited to its format and site descriptions, are protected by the copyright laws of the United States. However, you may freely reproduce any of the original material for noncommercial purposes if you provide notice to Zeiss and properly cite Zeiss or the applicable author as the copyright owner. Reproduction for commercial purposes is strictly prohibited without the prior written consent of Zeiss. Zeiss does not have the authority to permit third parties to reproduce any of the material in the sites linked to the EOC. Therefore, any third parties interested in reproducing such material should address the relevant author or organization directly.

    

   III. USERS

   1. TYPES OF USERS

   Please be aware that certain activities on the EOC are available only to persons who are registered users.

   2. USERNAME AND PASSWORD

   You are responsible for maintaining the confidentiality of your username and password. You shall be responsible for all uses of your username, whether or not authorized by You. You agree to immediately notify Zeiss of any unauthorized use of your username and password.

   3. YOUR OBLIGATIONS AND CONDUCT

   In consideration of Your use of the EOC, You agree to: (a) maintain and promptly update any information You provide to Zeiss, to keep it accurate, current and complete; and (b) accept all risks of unauthorized access to the information.
   
   You are entirely responsible for all Content that You upload, post or otherwise transmit via the EOC. You agree not to upload, post or otherwise transmit via the EOC Content that: (a) is inaccurate, harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, or otherwise objectionable to Zeiss or other users of the EOC; (b) includes unauthorized disclosure of personal information; (c) violates or infringes anyone's intellectual property rights; or (d) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. Zeiss reserves the right to edit or remove Content that violates these Terms or that contains third-party commercial advertisements.
   
   You agree that You will not use the EOC to: (a) transmit spam, bulk or unsolicited communications; (b) pretend to be Zeiss or someone else, or spoof Zeiss's or someone else's identity; (c) forge headers or otherwise manipulate identifiers (including URLs) in order to disguise the origin of any Content transmitted through the Services; (d) misrepresent your affiliation with a person or entity; (e) disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users' ability to use the EOC; (f) engage in activities that would violate any fiduciary relationship, any applicable local, state, national or international law, or any regulations having the force of law, including but not limited to attempting to compromise the security of any networked account or site, stalking, or making threats of harm; or (g) collect or store personal data about other users unless specifically authorized by such users.

   4.  POSTING INFORMATION ON THE EOC

   You are responsible for the content of any Information you put on the EOC. The Information posted to the EOC does not necessarily reflect the views of Zeiss and in no event shall Zeiss assume or have any responsibility or liability for any information posted to the EOC or for any claims, damages or losses resulting from the use and/or appearance of such information on the EOC. Zeiss has no obligation to, and does not in the normal course, monitor or control any Information that is or becomes available on the EOC. Zeiss reserves the right to review any Information that is or becomes available on the EOC. Zeiss reserves the right to refuse to post or to edit or remove, in whole or in part, any Information that is, in Zeiss's sole discretion, unacceptable, undesirable or in violation of these rules. Zeiss has no obligation to exercise such reservation of rights by Zeiss; however, Zeiss has adopted and implemented a policy respecting the copyright law that provides for the termination in appropriate circumstances of users of the EOC who are repeat infringers. Zeiss may terminate access for content providers or forum participants who are found repeatedly to provide or post protected material without necessary rights and permissions. By submitting information to Zeiss, you grant Zeiss a perpetual, royalty-free, worldwide license to use, transmit, copy and display such information in any and all media now known or hereinafter devised and represent that you have all necessary rights in such posting.

   III. SITE USE

   1.  ACCESS AND USE

   All materials contained in this the EOC are protected by international trademark and copyright laws and must only be used for personal, non-commercial purposes. This means that you may only view or download material from this website for your own use and you must keep all copyright and other proprietary notices attached to the downloaded material.
   
   The reproduction, duplication, distribution (including by way of email, facsimile or other electronic means), publication, modification, copying or transmission of material from this the EOC is STRICTLY PROHIBITED unless you have obtained the prior written consent of Zeiss or unless it is expressly permitted by this the EOC. The material covered by this prohibition includes, without limitation, any text, graphics, logos, photographs, audio or video material or stills from audiovisual material available on this the EOC. The use of materials from this the EOC on any other web site or networked computer environment is prohibited. Requests for permission to reproduce or distribute materials found on this the EOC can be made by contacting zeissoct@meditec.zeiss.com.

   2.  AVAILABILITY OF THE SERVICES

   While Zeiss will make all reasonable efforts to ensure that the Services are available at all times, Zeiss does not guarantee, represent or warrant that your access to any of the Services will be uninterrupted or error-free. In addition, while Zeiss makes reasonable efforts to ensure that all Content and/or information submitted by you to Zeiss will be secure, Zeiss does not guarantee that the Services will be free from loss, corruption, attack, viruses, "worms", "trojan horses" or other harmful components, or from interference, hacking or other security intrusions. Zeiss may change, suspend or discontinue any of the Services at any time. Zeiss may also impose limits on the use of or access to certain features or portions of the Services, in any case without notice or liability.

   IV. LINKS TO THIRD PARTY SITES

   Zeiss's web site may contain links to other sites such as the OCT Image Gallery. These sites are not controlled by Zeiss and Zeiss is not responsible for any content contained on any such website. While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the privacy practices employed by other sites. As with our site, you should become familiar with any external party's privacy policy when visiting that site.

   V.  PRIVACY

   Zeiss is committed and recognizes your need for protection and privacy issues on the Internet.  In general, you can visit the EOC without telling Zeiss who you are or revealing any information about yourself.  Zeiss reserves the right to collect the IP addresses and domain names of visitors for site administration purposes, such as to analyze this data for trends and statistics; however, no personal information is obtained, rather just the patterns of usage of our various users may be tracked and monitored.  Zeiss may share statistical or aggregated non-personal information about EOC visitors with advertisers, business partners, sponsors and other third parties. This data is used to customize Zeiss’s website content and advertising to deliver a better experience to our users.

   VI.  COLLECTING PERSONAL IDENTIFIABLE INFORMATION

   There are times when Zeiss may collect personal information from you.  Zeiss may also request personal information when you register to receive additional information regarding our products and services or send us a question. If you choose not to give information requested, you can still visit most of the EOC, but you may be unable to access certain options, offers, and services. Unless otherwise stated, personal information provided by users will be used for marketing and promotional purposes only by Zeiss.

   Zeiss may collect the following information from you voluntarily:

   1. Your name

   2. Address, either work or home

   3. Your birth date

   4. Your medical or ophthalmic school name and graduation date

   5. Locations of your practice

   VII.  MAILING LIST

    

   Personal information of registrants of the EOC may be used by Zeiss for its own promotional purposes. Zeiss will not share this information with any third party without your express permission. You may remove yourself from EOC's mail list by contacting EOC at: zeissoct@meditec.zeiss.com.

   VIII.  REMOVING OR UPDATING PERSONAL INFORMATION

   In case you change your mind or wish to update personal information (such as your zip code), Zeiss will endeavor to correct, update or remove the personal data you provide.   

   Zeiss reserves the right to disclose user information in special cases, when it has reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other web site users, or anyone else that could be harmed by such activities. Zeiss may disclose personal information in response to a subpoena or when Zeiss believes in good faith that the law requires it or to respond to an emergency situation.
